These Terms and Conditions ("Terms") govern your access to and use of the website located at https://www.pinky-deal.com/ (the "Site") and the purchase of products offered by PINKY-DEAL LLC ("Company," "we," "our," or "us"). By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use this Site.

We reserve the right to refuse service, suspend accounts, or cancel orders at our sole discretion.

Pinky Deal offers plant-based protein powders, dietary supplements, fitness accessories, apparel, and related wellness merchandise. Our product catalog may expand over time without prior notice.

Product descriptions, ingredient lists, nutritional information, images, pricing, and availability are subject to change without notice. We make reasonable efforts to accurately display products; however, we do not guarantee that your device display will perfectly reflect the actual product colors or appearance.

4. HEALTH AND FDA DISCLAIMER

IMPORTANT: The statements made on this Site have not been evaluated by the U.S. Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.

5. ACCOUNT REGISTRATION

We reserve the right to suspend or terminate accounts involved in fraud, abuse, unauthorized resale, discount code misuse, or any conduct that violates these Terms.

6. PRICING AND PAYMENT

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. Payments are processed securely through Shopify and its supported payment processors.

By submitting payment information, you represent and warrant that:

You are authorized to use the payment method provided;
The billing information you submit is accurate and complete.

We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, pricing errors, inventory limitations, or violations of these Terms.

7. DISCOUNT CODES, PERSONAL CODES, AND PROMOTIONS

We may issue personal discount codes, referral codes, promotional campaigns, or ambassador-exclusive codes. The following rules apply to all discount codes:

Codes may not be combined with other offers unless expressly stated;
Codes may carry expiration dates and may be revoked at any time;
Codes have no cash value and are non-transferable;
Each code is intended for the individual recipient only, unless otherwise stated;
Unauthorized redistribution, resale, or public sharing of personal codes is prohibited.

We reserve the right to cancel orders, void codes, and deactivate accounts associated with promotional abuse, automated exploitation, or fraudulent activity.

8. SHIPPING

We currently ship to the contiguous United States only. We do not ship to Alaska, Hawaii, U.S. territories, or P.O. Boxes at this time. Estimated delivery times are provided for convenience and are not guaranteed.

Orders may be fulfilled and shipped through third-party fulfillment partners, including Supliful. PINKY-DEAL LLC is not responsible for delays caused by:

Shipping carriers;
Severe weather or natural disasters;
Incorrect shipping information provided by the customer;
Events beyond our reasonable control (force majeure).

Risk of loss and title transfer to the customer upon delivery of the order to the shipping carrier.

9. RETURNS, REPLACEMENTS, AND REFUNDS

9.1 General Policy

Due to the consumable and perishable nature of dietary supplement products, we do not accept general returns or guarantee refunds. All sales are considered final unless a qualifying issue is identified.

Apparel and non-consumable accessories may be eligible for return consideration if unworn, unwashed, and in original condition with tags attached, subject to our approval.

9.2 Defective, Damaged, or Incorrect Products

If your order arrives damaged, defective, or incorrect, you must contact us within thirty (30) days of delivery. Your claim must include:

A clear description of the issue;
Photographic evidence of the defect or damage;
Your order number and contact information.

Claims submitted after thirty (30) days of delivery will not be eligible for resolution.

9.3 Resolution Options

Approved claims may result in one of the following, at our sole discretion:

A replacement product shipped at no additional charge;
A partial refund to the original payment method;
Store credit;
A full refund in exceptional cases.

Shipping costs are non-refundable unless the issue resulted from our error or a manufacturing defect confirmed by our fulfillment partner.

9.4 Fulfillment Partner Limitations

Products are fulfilled through Supliful. Supliful's policy covers reprints, replacements, or refunds exclusively for cases involving misprints, manufacturing defects, or product damage, provided a valid claim with photographic evidence is submitted within thirty (30) days of delivery. PINKY-DEAL LLC will coordinate with Supliful to resolve eligible claims; however, resolutions are subject to Supliful's review and approval process.

Claims not covered by Supliful's policy (e.g., customer remorse, incorrect orders placed by the customer, or preference-based returns) will be evaluated solely at the discretion of PINKY-DEAL LLC.

9.5 Fraud and Abuse

We reserve the right to deny any refund or replacement request that we reasonably suspect involves fraud, misuse, or repeated abuse of our return process.

10. INFLUENCERS, AFFILIATES, AND BRAND AMBASSADORS

PINKY-DEAL LLC may collaborate with content creators, influencers, affiliates, and brand ambassadors ("Partners"). By entering into any such collaboration, Partners agree to the following:

Partners may not make medical claims, unsubstantiated health claims, or misleading statements about our products;
Partners must comply with FTC disclosure guidelines and applicable advertising laws;
Unauthorized use of our trademarks, branding, product images, or promotional materials is prohibited;
Assigned discount codes are for Partner use only unless otherwise specified;
Partners may not publicly share exclusive codes without prior written authorization.

We reserve the right to terminate any affiliate or ambassador relationship at any time and to revoke commissions, codes, or benefits in cases of fraud, misrepresentation, false advertising, brand misuse, or any violation of these Terms or applicable law.

11. PROHIBITED USES

You agree not to use this Site to:

Violate any applicable federal, state, or local laws or regulations;
Engage in or facilitate fraudulent transactions;
Attempt to gain unauthorized access to any part of the Site or its systems;
Use bots, scrapers, or automated tools to access or extract Site content;
Resell or redistribute our products without prior written authorization;
Misrepresent your identity or affiliation with any person or entity;
Infringe upon the intellectual property rights of PINKY-DEAL LLC or any third party;
Upload malicious code, viruses, or harmful content;
Interfere with the security, integrity, or availability of the Site.

Violations may result in immediate account termination and, where applicable, legal action.

12. INTELLECTUAL PROPERTY

All content on this Site, including but not limited to logos, trademarks, brand names, product names, text, graphics, images, videos, product packaging, website design, marketing materials, social media content, and promotional assets, is owned by or licensed to PINKY-DEAL LLC and is protected under applicable U.S. and international intellectual property laws.

No content may be copied, reproduced, distributed, modified, republished, uploaded, posted, transmitted, or exploited in any form without our prior written consent.

13. USER-GENERATED CONTENT

By submitting reviews, testimonials, photos, social media tags, comments, or other content ("User Content") to us or tagging us on social media, you grant PINKY-DEAL LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content across all media formats, including paid advertising, without compensation to you.

You represent and warrant that:

You own or have obtained all necessary rights and permissions to submit the User Content;
Your User Content does not violate any applicable law, regulation, or third-party rights.

We reserve the right to remove any User Content at our sole discretion without notice.

14. ADVERTISING TECHNOLOGIES AND TRACKING

We use advertising and analytics technologies from third-party platforms, including Meta (Facebook and Instagram), TikTok, and Google, to measure performance and deliver targeted advertising. These technologies may include pixels, cookies, and similar tracking tools that collect data about your interactions with our Site and ads.

By using our Site, you acknowledge and consent to the use of such technologies as described in our Privacy Policy. You may manage your advertising preferences through your browser settings or the privacy settings of the respective platforms.

15. THIRD-PARTY SERVICES

Our Site integrates with third-party services, including Shopify (e-commerce platform), payment processors, analytics providers, advertising platforms, shipping carriers, and fulfillment partners such as Supliful. We are not responsible for the privacy practices, policies, or conduct of any third-party service.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

18. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINKY-DEAL LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUPPLIERS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE APPLICABLE PRODUCT. SOME STATES DO NOT ALLOW CERTAIN LIMITATION OF LIABILITY PROVISIONS, IN WHICH CASE THE ABOVE LIMITATIONS MAY NOT FULLY APPLY TO YOU.

19. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless PINKY-DEAL LLC and its affiliates, officers, directors, employees, contractors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of or access to the Site;
Your violation of these Terms;
Your misuse of any products purchased;
Your violation of any applicable law or third-party rights.

20. DISPUTE RESOLUTION AND ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO A JURY TRIAL.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products purchased from PINKY-DEAL LLC shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

The arbitration shall take place in the State of Wyoming, unless the parties mutually agree to a different location or to proceed via remote hearing. You agree that:

Arbitration will occur on an individual basis only;
You waive any right to participate in class action lawsuits or class-wide arbitration;
You waive any right to a jury trial.

Nothing in this section prevents either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

21. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. To the extent that arbitration does not apply, you consent to exclusive jurisdiction and venue in the state and federal courts located in Wyoming.

22. FORCE MAJEURE

PINKY-DEAL LLC shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, supply chain disruptions, labor disputes, government actions, internet or power outages, cyberattacks, shipping carrier failures, or other events constituting force majeure.

23. MODIFICATIONS TO TERMS

We reserve the right to update, modify, or replace these Terms at any time. Changes will become effective immediately upon posting to the Site with an updated Effective Date. Your continued use of the Site following any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

24. SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions.

25. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PINKY-DEAL LLC regarding your use of the Site and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
